If the participant is a minor, by signing this waiver, I, as the parent or legal guardian of the minor participant, acknowledge and agree to all terms and conditions herein on behalf of the minor. I further affirm that I have the legal authority to provide such consent and to assume the risks and responsibilities outlined in this document on the minor’s behalf.

JapanBall.com and related sites are not business entities, but simply web-marketing vehicles by which we distribute information about the tours.
We started Extra Innings, Inc., a Washington State corporation, to own and operate the tour.
Extra Innings, Inc., a Washington State corporation, is licensed as a registered seller of travel in the State of Washington.
Trip payments are deposited in the Extra Innings, Inc. Trust Account at Wells Fargo Bank in compliance with Washington State travel regulations.
Extra Innings, Inc. purchases hotel, restaurant, transportation services, event tickets, and other products from independent suppliers not subject to our control. Therefore, we cannot be liable for any injuries, damages, or losses that may occur due to any action or omission of such suppliers, their agents, employees, or suppliers, or by any event over which we have no control.
By embarking upon travel you voluntarily assume the risks of such travel and we advise you to obtain insurance coverage as may be available against risks of such travel.
You acknowledge that there are many risks and uncertainties inherent in travel including, but not limited to, the hazards of various modes of transportation, forces of nature, weather, acts or omissions of foreign governments, terrorism, war or insurrection, theft, illness and damage to person or property due to the negligent acts or omissions of tour operators and other third parties.
We shall not be responsible for any injuries, damages or losses caused by social or labor unrest, mechanical or construction difficulties, criminal activities, disease or sickness, local laws, climatic conditions, or any other action, omissions or conditions outside our control. We strongly recommend you obtain health and travel insurance to cover such risks.
You assume full and complete responsibility to check and verify any and all passport, visa, vaccination, or other entry requirements at each destination on your itinerary, along with all safety and security conditions at such destinations, including travel advisories. Information about some of these items may be found at the passport and/or travel advisory sections at the website or other public source of your country’s secretary of state.
In case of a postponement of an event there shall be no refund except to the extent such may be available to us, which we will pass along to you.Dates, schedules, program details and costs, are provided in good faith based on information available at the time of publication, but all such items are subject to change and revision without notice.
Every effort will be made to carry out the program as planned, but alterations may occur without penalty to us. We reserve the right, without penalty, to make changes in the itinerary whenever, in our sole judgment, conditions warrant.
We reserve the right, without penalty, to withdraw a tour announced, to decline to accept any person as a participant in a tour, or to require any participant to withdraw from a tour at any time when we determine such action to be in the best interests of the health, safety or general welfare of the tour group or the individual participant, subject only to the requirement that the recoverable portion of the total amount paid that corresponds to the cost of unused services and accommodations be refunded, if any, and only to the extent that such may be refunded or otherwise available to us.
We accept no liability for the purchase of non-refundable airline tickets, accommodations, transportation arrangements, event tickets, or any other goods or services made or reserved in anticipation of or related to this travel. Participants assume full responsibility for ensuring the terms, conditions, and refundability of such purchases, and any losses incurred due to changes, cancellations, or postponements are solely the responsibility of the participant.
Baggage and personal effects are at all times the sole responsibility of the participant. Extra Innings, Inc. is not liable for loss or damage to personal belongings. We recommend appropriate insurance coverage.You acknowledge that this particular tour includes attendance at professional baseball games and other sporting events, and exposure to risks inherent in that venue including, specifically but not exclusively, the risks of bats and balls leaving the field of play and striking you wherever you may be in the stadium, and the risks of fall or other injury as you traverse the stadium, its stairs, aisles, and other areas.
You acknowledge that this particular tour includes participation in baseball games, practices, and related athletic activities, and accept the inherently involved risks. These risks include, but are not limited to, physical injury from contact with balls, bats, equipment, other players, or surfaces; muscle strains or sprains; collisions; and exposure to varying weather conditions. You understand that while reasonable measures will be taken to ensure safety, unforeseen incidents may occur. You voluntarily assume all risks associated with these activities and agree to hold harmless Extra Innings, Inc., its staff, coaches, volunteers, and affiliates from any claims or liabilities arising out of your participation in the trip and associated events.
The countries that our tours travel to, including but not limited to Japan, South Korea, and the Dominican Republic, are not ADA accessible and, therefore, we cannot be held responsible for denial of service by transportation carriers, hotels, restaurants or other suppliers. We are not equipped to give individual help for walking, dining, getting on and off transportation, or other needs. Travelers requiring assistance must travel with a companion capable of providing aid. Extra Innings, Inc. assumes no responsibility for accessibility issues.
By attending one of our tours, you grant to Extra Innings, Inc. and its subsidiaries, affiliates, agents, representatives and designees the irrevocable, non-exclusive, non-transferable, royalty-free perpetual right and license to use and display your likeness, name, username, and/or social media handle in a photo, video, or other media form (collectively, “Likeness”) and any of your photos, videos, or other media that you share with Extra Innings Inc. either physically or digitally (e.g. via email, text message, or social media platforms) (collectively, “Photo”) for any and all purposes, including marketing, promotion or advertising, in any and all media channels and social platforms (now known or hereafter existing), without compensation, payment or other consideration of any kind.
Extra Innings Inc. may use, display, edit, alter, reproduce, create derivative works from, publish or distribute the Likeness and/or Photo for any lawful purpose in its sole discretion, with no obligation to your or right of inspection or approval.
Any dispute or claim arising out of or related to JapanBall and Extra Innings Inc, its agents or assigns, shall be settled solely by binding arbitration in Snohomish County, Washington State, in accordance with the Commercial Arbitration Rules of the American Arbitration Association, before a single arbitrator selected in accordance with those rules. Any judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction of such matter.
